1. Acceptance of Terms

By accessing or using Invictus AI's WhatsApp Business API platform at wa-invictus.in, you agree to be bound by these Terms of Service and our Privacy Policy.

2. Service Overview

Invictus AI provides a subscription-based WhatsApp Business API platform that enables businesses to manage customer communications, automate messaging, and integrate AI-powered chatbots.

3. Account Registration

You must provide accurate and complete information during registration. You are responsible for maintaining the security of your account credentials and for all activities under your account.

4. Subscriptions & Billing

• Services are billed monthly or annually based on your chosen plan
• Service access begins upon successful payment confirmation
• You are responsible for keeping billing information up to date
• Prices are subject to change with 30 days advance notice

5. Acceptable Use

You agree not to use our platform for:

• Sending spam, unsolicited, or bulk messages
• Any illegal, fraudulent, or abusive activities
• Violating WhatsApp's Business Policy or Commerce Policy
• Distributing malware or harmful content
• Impersonation or misleading communications

6. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by third-party services including Meta/WhatsApp.

7. Account Suspension & Termination

We may suspend or terminate accounts for:

• Violation of these terms or WhatsApp policies
• Non-payment of subscription fees
• Fraudulent or illegal activity

8. Cancellation & Refunds

• Cancel anytime via email or phone — service continues until end of billing cycle
• Monthly plans: No refunds for partial periods
• Annual plans: Pro-rated refund within 15 days of purchase
• Duplicate/failed payments: Fully refundable upon verification

9. Limitation of Liability

Invictus AI shall not be liable for any indirect, incidental, or consequential damages. Our total liability is limited to the amount paid by you in the preceding 12 months.

10. Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the jurisdiction of courts in Maharashtra, India.
